Man, 28, remanded over alleged oral sex with 5 year-old girl

An Ilorin Magistrates’ Court on Tuesday ordered a 28-year old man, Emmanuel Andrew, to be remanded at Federal Prison in Ilorin over alleged oral sex with a five-year old girl. Andrew of Amoyo area of Ilorin is facing a two-count charge of gross indecency and unlawful sexual intercourse with a minor.
Earlier, the Prosecutor, Cpl. Sanni Abdullahi, told the court that on April 26, the victim’s mother caught her daughter naked in the accused room where he was putting his finger into her private part. Abdullahi said that the accused under investigation confessed that sometimes in February, he took the girl to his room and put his penis into her mouth to suck till he discharged sperm. He said that the act amount to having oral sex with the victim. Abdullahi said that the offences contravened Section 285 of Penal Code Law and Section 31 of Child Right Law No. 9, 2006. The accused, however, pleaded not guilty. The prosecutor opposed the bail application of the accused. He urged the court to remand him in prison custody pending the conclusion of investigation. The Defence Counsel, Mr Shina Ibiyemi, applied for bail for the accused. He argued that the accused should still be presumed innocent until proven guilty by the court. The Magistrate, Shakirat Olanipekun, refused the bail application and ordered the accused to be remanded. Olanipekun adjourned the case till May 11 for further mention.
